Certification centers for obtaining digital signatures, accredited by the Ministry of Telecom and Mass Communications of Russia

With development modern technologies electronic document management is gaining more and more popularity. To give electronic documents legal significance, they should be certified with an electronic digital signature (EDS).

An electronic digital signature is an analogue of a handwritten signature, obtained using a cryptographic information converter.

There are 2 types of digital signature: simple and enhanced.

A simple digital signature consists of a set of characters and passwords. A striking example The use of such a signature is provided by online banking. IN in this case entering your login and password into the service login form, as well as the password received on your phone as confirmation of the operation, are a simple electronic signature.

There are two types of enhanced signature: unqualified and qualified.

An unqualified digital signature allows you to establish authorship, as well as identify the presence of corrections to a document after it has been signed. Moreover, in most cases, such a signature is issued with a USB carrier of the digital signature verification key certificate.

A qualified digital signature has all the properties of an unqualified analogue, but the digital signature verification key certificate is a mandatory attribute qualified signature, which is issued only by an accredited CA. In this case, the token (removable media of the electronic certificate), as well as the accompanying software, is certified by the FSB of the Russian Federation.

In most cases, you can obtain such a certificate by contacting certifying EDS center(UC). At the same time, in Ministry of Telecom and Mass Communications certification centers, those generating a qualified digital signature must undergo accreditation.

Head Center

Ministry of Telecom and Mass Communications of Russia-head certification center(GTC), performing its functions on the basis of the Decree of the Government of the Russian Federation “On the federal executive body authorized in the field of using electronic signatures” dated November 28, 2011 No. 976. List of documents for accreditation

To obtain accreditation from the Ministry of Telecom and Mass Communications, a representative of the CA should send to the department an application for an accreditation certificate and a package of necessary documents:

1. Copies work records and contracts with at least two employees performing the functionality of creating and issuing EDS key certificates. At the same time, workers must have higher education in the field of information security and technology or secondary education followed by additional education on how to use digital signatures.
2. Founding papers.
3. Documents confirming the legality of use software, which will subsequently be used to generate digital signature keys that meet the requirements for a qualified digital signature.
4. A copy or extract from the balance sheet confirming that the valuation of net assets is more than 1 million rubles.
5. A document allowing an authorized person to act on behalf of the CA.
6. A document that confirms that the CA has financial support (more on this below).
7. Other documents as required by the head center.

Papers can be submitted to the Ministry of Telecom and Mass Communications in person, through a representative, by mail, or sent through a single portal (see address below).

CA liability insurance

Accredited certification centers must ensure their liability to third parties for possible losses in the amount of 1.5 million rubles by providing the State Center with the supporting document specified in clause 5 of the previous section. Such a document could be:

• guarantee agreement;
• bank guarantee (the CA should additionally indicate the bank license number);
• liability insurance contract (the State Center checks the presence of the insurance company in the Unified State Register of Insurance Business Entities).

The CA receives accreditation and an electronic digital signature

Application for accreditation of electronic signature certification centers is considered within 30 days, during which the State Center makes a decision to issue or refuse to issue an accreditation certificate. If the answer is positive, the Ministry of Telecom and Mass Communications will issue the decision document itself within 5 days. Within up to 10 days from the date of the decision, sends a notification to the CA and issues an accreditation certificate and a qualified certificate generated using the signature creation tools of the Ministry of Telecom and Mass Communications. And after issuing the certificate, within 24 hours it places information about the new CA on a single portal. If a negative decision is made, the State Center sends to the CA a corresponding notice on paper indicating the reasons for the refusal.

List of certification centers authorized to issue an electronic digital signature

Head certification center of the Ministry of Telecom and Mass Communications leads:

1. Register of accredited certification centers, which contains the names and addresses of the CA.
2. Register of certification centers with revoked accreditation.
3. List of qualified certificates issued and canceled by the State Center.
4. List of certification authorities with suspended accreditation.
5. List of certifiers EDS centers , whose activities have been discontinued.

On what resource is the CA register published (single website)

List of accredited certification centers of the Ministry of Telecom and Mass Communications, as well as all of the above lists, the State Center places them on the single portal of the authorized federal body in the field of using electronic signatures at https://e-trust.gosuslugi.ru.

Regulations for the operation of the CA (agreement on accession to the form) using the example of the CA “Kartoteka”

Accredited digital signature certification centers develop their own operating regulations on the basis of current legislation. The Regulations are an accession agreement, that is, the terms of the agreement are determined by law and the Ministry of Telecom and Mass Communications, and the subscriber agrees to these provisions by joining the form (Article 428 of the Civil Code of the Russian Federation).

For example, the regulations of the Card Index UC contain the following information:

1. About the CA itself, including details.
2. Algorithm for joining a form.
3. Procedure for providing information.
4. Rights and obligations of the parties.
5. The procedure for charging fees for services for generating a qualified digital signature.
6. Responsibility of the parties.
7. Algorithm for the provision and use of center services.

Results

EDS can be obtained from any accredited certification center. List of accredited digital signature certification centers publishes Ministry of Telecom and Mass Communications-head verification Center. List of certification centers, accredited by the Ministry of Telecom and Mass Communications of Russia, can be downloaded on the department’s unified website at: e-rust.gosuslugi.ru.

1. Accreditation of certification centers is carried out by the authorized federal body in relation to certification centers that are legal entities.

2. Accreditation of a certification center is carried out on a voluntary basis. Accreditation of a certification center is carried out for a period of five years, if more short term not indicated in the certification authority's application.

3. Accreditation of a certification center is carried out subject to its fulfillment of the following requirements:

1) the value of the net assets of the certification center is not less than seven million rubles;

2) the presence of financial security for liability for losses caused to third parties as a result of their trust in the information specified in the electronic signature verification key certificate issued by such a certification center, or information contained in the register of certificates maintained by such a certification center, in an amount not less than 30 million rubles and 500 thousand rubles for each place of implementation of a licensed type of activity, specified in the license of the federal executive body in the field of security, issued to the certification center in accordance with paragraph 1 of part 1 of article 12 Federal Law dated May 4, 2011 N 99-FZ "On licensing individual species activities" if the number of such places exceeds ten, but not more than 100 million rubles. If the number of places where the specified licensed type of activity is carried out does not exceed ten, financial support liability is 30 million rubles;

3) the availability of electronic signature means that have confirmation of compliance with the requirements established by the federal executive body in the field of security, as well as means of a certification center that allows, when an electronic interaction participant applies, to establish and confirm the validity of a qualified certificate at the time of signing with an electronic signature electronic document and having confirmation of compliance with the requirements established by the federal executive body in the field of security;

4) the presence on the staff of the certification center of at least two employees who are directly involved in the creation and issuance of certificates of keys for verifying electronic signatures, who have a higher education in the field information technologies or information security or higher education or secondary vocational education followed by additional vocational education on the use of electronic signatures;

5) the availability of a certification center applying for accreditation to a procedure for implementing the functions of a certification center and performing its duties, established by the certification center in accordance with those approved by the federal executive body exercising the functions of developing and implementing state policy and legal regulation in the field of information technologies, requirements for the procedure for implementing the functions of an accredited certification center and performing its duties, as well as with this Federal Law and other regulatory legal acts adopted in accordance with it.

3.1. The certification center, along with the requirements specified in Part 3 of this article, also has the right to ensure its compliance with the additional requirements established by the federal executive body in the field of security, in agreement with the authorized federal body, for the procedure for implementing the functions of an accredited certification center and performing its duties, as well as for providing information security of an accredited certification center in cases where the need to comply with such additional requirements in certain respects is provided for by federal law.

4. Accreditation of a certification center is carried out on the basis of its application submitted to the authorized federal body. The application shall be accompanied by documents confirming the compliance of the certification center with the requirements established by part 3 of this article. The certification center has the right not to submit a document confirming the compliance of its existing electronic signature means and the means of the certification center with the requirements established by the federal executive body in the field of security, if such a document or the information contained in it is at the disposal of the federal executive body in the field of security . In this case, the authorized federal body independently verifies the availability of a document confirming the compliance of such means with the established requirements, based on information received from the federal executive body in the field of security, using a unified system of interdepartmental electronic interaction. The certification center has the right to attach documents confirming the compliance of the certification center with the requirements established by part 3.1 of this article.

5. Within a period not exceeding thirty calendar days from the date of receipt of the certification center’s application, the authorized federal body, on the basis of the submitted documents, makes a decision on the accreditation of the certification center or on the refusal of its accreditation. If a decision is made to accredit a certification center, the authorized federal body, within a period not exceeding ten calendar days from the date of the decision on accreditation, notifies the certification center about the decision taken and issues a certificate of accreditation in the prescribed form. After receiving the accreditation certificate, the accredited certification center is obliged to carry out the accession information system, ensuring the implementation of the functions of an accredited certification center (hereinafter referred to as the connection of an accredited certification center) to the information, technological and communication infrastructure in the manner established in accordance with Part 4 of Article 19 of the Federal Law of July 27, 2010 N 210-FZ "On the organization of the provision of state and municipal services" (hereinafter - infrastructure). After joining the accredited certification center to the infrastructure, the authorized federal body issues to the accredited certification center a qualified certificate created using the funds of the head certification center. If a decision is made to refuse accreditation of a certification center, the authorized federal body, within a period not exceeding ten calendar days from the date of the decision to refuse accreditation, sends or delivers to the certification center a notice of the decision, indicating the reasons for the refusal.

6. The basis for refusal to accredit a certification center is its non-compliance with the requirements established by part 3 of this article, or the presence of unreliable information in the documents submitted by it.

7. An accredited certification center must comply with the requirements for which it is accredited throughout the entire period of its accreditation. If circumstances arise that make it impossible to comply with these requirements, the certification center must immediately notify the authorized federal body in writing. An accredited certification center, when performing its functions and fulfilling its obligations, must comply with the requirements established for certification centers - and this Federal Law. The authorized federal body has the right to conduct inspections of compliance by accredited certification centers with the requirements of this Federal Law and other regulatory legal acts adopted in accordance with this Federal Law, including the requirements for compliance with which these certification centers were accredited, during the entire period of their accreditation. If an accredited certification center fails to comply with these requirements, the authorized federal body is obliged to issue this certification center an order to eliminate violations within a specified period and suspend the accreditation for given period with the inclusion of information about this in the list specified in paragraph 4 of part 3 of article 8 of this Federal Law. The accredited certification center notifies the authorized federal body in writing about the elimination of identified violations. The authorized federal body makes a decision on the renewal of accreditation, while it has the right to verify the actual elimination of previously identified violations and, if they are not eliminated within the period established by the order, prematurely terminates the accreditation of the certification center.

7.1. Inspections of compliance by accredited certification centers with the requirements of this Federal Law and other regulations adopted in accordance with it are carried out once every three years throughout the entire accreditation period, with the exception of unscheduled inspections carried out in accordance with the law. Russian Federation. The first scheduled inspection of compliance by accredited certification centers with these requirements is carried out no later than one year from the date of accreditation of the certification center specified in the certificate of accreditation of the certification center.

7.2. Unscheduled inspections within state control(supervision) and municipal control are carried out on the grounds specified in Part 2 of Article 10 of the Federal Law of December 26, 2008 N 294-FZ “On the Protection of Rights legal entities And individual entrepreneurs in the exercise of state control (supervision) and municipal control", as well as on the basis of motivated requests for violations of the requirements of this Federal Law and other regulatory legal acts adopted in accordance with it, approved by an accredited certification center, which were received by the authorized federal body from the federal executive bodies authorities, bodies state power constituent entities of the Russian Federation, other government bodies, local government bodies, the Central Bank of the Russian Federation, government bodies off-budget funds, legal entities and individuals.

8. On government bodies, local governments, state and municipal institutions performing the functions of certification centers are not subject to the requirements established by paragraphs 1 and 2 of part 3 of this article.

9. The main certification center, the functions of which are performed by an authorized federal body, is not subject to accreditation in accordance with this Federal Law.

Which certification authority should you choose?

Note that all CAs are divided into 2 types:

• Accredited, having the right to issue a qualified electronic signature.
• Unaccredited, issuing unqualified digital signature.

The second type of digital signature is distinguished by the fact that it has an extremely limited scope of application, as well as low security. If you plan to work with government agencies(Electronic government, Rosreestr, MV Portal of the Federal Property Management Agency, etc.), then this type of signature will not suit you. It is more expedient to immediately make a qualified digital signature: a document signed with such a signature is completely equivalent to a paper one.

Therefore, we will only search for accredited CAs.

How to find them?

Accreditation of all CAs is carried out by the Ministry of Telecom and Mass Communications of Russia in accordance with Article 16 of Federal Law No. 63. The law specifies all the requirements for organizations wishing to obtain accreditation. If they are completed, a Certificate is issued giving the right to issue certificates of qualified electronic keys. Accreditation is issued for a period of 5 years, after which the CA must pass it again.

On ministry website you can download the most current list accredited CAs. Download it and study it carefully.

For those who plan to use digital signature to work with the Rosreestr portal, you should familiarize yourself with list of CAs, who fulfilled the requirements of the order of Rosreestr dated March 27, 2014 No. R/32.

How to work with a list?

There are 402 organizations on the list. My head is spinning, isn't it? How to make the final choice?

• Firstly, you can find CAs located in your region and contact them. They are in everyone big city. For example, in Penza this is OJSC “E-Government Operator” and the Penza Region branch of the Pension Fund of Russia.
• Secondly, you can find a large certification center that, although registered in another city, operates throughout Russia (or has branches).
